Your benefits following a wrongful termination continue in Texas

Have you lost a job due to a wrongful termination in Texas? Losing your job in that way can be heartbreaking and stressful, but there are ways to make sure you continue to get the money and benefits you need. Make sure you take these steps to keep yourself covered while you pursue your wrongful termination lawsuit.

First of all, you need to collect any final compensation you deserve from your employer. You may be entitled to severance pay as well, which could go even further helping you pay the bills. State laws do vary in these circumstances, but in some states, an employer has to issue a final paycheck immediately, on the next payday, within a certain time frame or on the next business day. In some cases, you may be able to claim compensation for your unused vacation time, too.

After that, you need to file for unemployment compensation. You can file a claim for unemployment benefits if you weren’t fired for deliberate or repeated misconduct and had been employed for a certain length of time. You may also need to prove your earnings, that you are able to work and that you can start work again immediately.

You can also keep healthcare coverage in many cases, and this is thanks to the Consolidated Omnibus Budget Reconciliation Act of 1986. With this act, you, as a former employee, may be able to continue your healthcare for up to 18 months after your termination through your employer’s plan. You may have to pay your full premium, but this still helps you remain covered for any illnesses or medical needs.
