What Can a Labor Lawyer in Laredo, TX. Do For Me?

For most employees, going up against your employer for discrimination or violation of your rights can be quite daunting. Many citizens of Laredo feel intimidated by their managers or employers and will often refrain from reporting violations of their labor rights due to a fear of retaliation or of not being listened to.

Employment lawyers can help take this strain off of you and do all of the hard work on your behalf. Having the backing of an experienced labor lawyer can significantly increase your chances of receiving compensation or getting other forms of justice, such as getting your job back.

Attorneys who are experienced with labor and employment law cases will help you lodge complaints to the relevant government board, such as the National Labor Relations Board (NLRB), carry out independent research, conduct an investigation, and take your case to a Texas court if necessary.

There are many facets of labor law, so it is important that you hire a lawyer that has experience dealing with the specific legal issue that affects you.

Types of Labor Law in Laredo, TX

Labor law can also be referred to as employment law in that it deals with many of the same topics. However, when we refer to employment disputes that are dealt with through groups such as a trade union, we specifically talk about labor law.

The most important job of a labor lawyer is to regulate Laredo employment contracts and to ensure that employers are holding up their obligations to their employees in the areas listed below.

Wage & Hour Disputes

One of the most common issues employers face in Texas is getting paid appropriately for overtime that they work. The Fair Labor Standards Act in Texas sets out the rules regarding overtime in Texas. It provides that when an employer works more than 40 hours a week, the extra hours must be paid at a rate of 1.5 times their usual salary.

Mandatory overtime is permitted in Laredo, with the exception of certain professions. There are also certain professions that are exempt from overtime such as tipped employees, and sales workers.

If you do not receive the pay you are entitled to by your employer, you should contact an attorney from our law practice today.

Minimum Wage

The minimum wage in Texas for those aged over 20 is $7.25 per hour, in accordance with the Federal Fair Labor Standards Act (FLSA). There are exceptions in place for students, who get $6.16 an hour, under 20’s, who get $4.25 an hour for the first 90 days, and employees who earn a certain amount of tips each month.

Under Texas law, you are legally entitled to petition your employer for a higher payment rate through means of collective bargaining. If you are a worker that receives tips, your employer is required to pay you up to at least $7.25 an hour. So, if your employer pays you $4 an hour, but you only receive $2 in tips, you are legally entitled to receive a higher level of payment.

The Texas Minimum Wage Act provides that all employees must receive earning statements from their employers that include their name, pay rate, deduction, hours worked, and net pay.

Employment Discrimination

Attorneys who focus on labor and employment matters can also help you with employment discrimination issues. Employment discrimination is strictly prohibited under federal and state law in Texas. You can file a complaint if you were discriminated against on the grounds of:

Employers in Texas are prohibited from basing any employment decisions based on the reasons listed above. This includes denying you a promotion, firing you, limiting the amount of work you receive, failing to offer you benefits, or any behavior that is discriminatory in nature.

Time Off Work

Laredo employment laws do not offer employees the right to take paid time off work, for holidays, sick leave, or any other reason. However, employees do reserve the right to take unpaid leave from work, in certain situations.

To legally take unpaid leave from work, workers must fall under the protection of the Family and Medical Leave Act. To receive protection from this Act, your place of employment must operate in more than one state and have at least 50 full-time employees.

If this act applies to you, you can request leave from your place of employment for 12 weeks for medical reasons, or to take care of an ill family member, newborn child, or adopted child.

For Laredo employers who are not covered under this Act, you must consult with your employer to determine what type of leave you are entitled to for the reasons listed above.

If your employer refuses to give you time off or refuses to give you your job back on return, you should contact one of our Laredo employment lawyers.
